Terms of sale
Last updated
These terms set out the basis on which we sell artwork to you through paulkenton.com. Please read them before you order. They sit alongside our Privacy Policy and Cookie Policy. If you have any questions, please contact us before you buy.
1. Who we are
You are buying from Paul Kenton Ltd, a company registered in England & Wales (Company No. 06295741), with a registered office at Bay Studio, Hele Business Park, Ilfracombe, Devon, EX34 9RA. You can reach us at [email protected] or through our contact page. In these terms, “we” and “us” mean Paul Kenton Ltd, and “you” means the person placing the order.
2. Placing an order
When you place an order you are making an offer to buy. We will send an email acknowledging that we have received it — this is not yet acceptance. A binding contract is formed only when we send you a dispatch confirmation, or otherwise confirm we accept your order. Please check the details before you buy — including that the artwork suits you, that its dimensions work for your space, and that delivery to your address is feasible.
3. Availability
Every original painting is a one-off, and limited edition prints are produced in a strictly limited run. Because stock is finite and shared across our gallery and other channels, an artwork is only reserved for you once your payment is complete — availability is on a first-to-pay basis. If an item becomes unavailable after you order (for example because it sold at the same moment through another channel), we will let you know promptly and give you a full refund.
4. Pricing & VAT
Prices in pounds sterling (GBP) include UK VAT. If you choose to view prices in euros or US dollars, they are shown without UK VAT and converted at an approximate rate, as a guide. Every order is charged in pounds sterling. UK VAT is charged on delivery to the UK and the Isle of Man; orders delivered anywhere else are charged without it, and any import duties or taxes due in the destination country are the buyer’s responsibility. The price you pay is the price shown at checkout, plus any delivery charge calculated there. We take care to price accurately, but if we spot a genuine error before your order is accepted we may cancel it and refund you in full rather than proceed at the wrong price.
5. Payment
We accept card payments through Stripe, our payment provider, which handles your card details securely — we never see or store your full card number. You can also choose Klarna at checkout, subject to Klarna’s own terms and eligibility checks; see our Pay with Klarna page. An artwork is dispatched once payment is complete: paid by card, or approved by Klarna.
6. Delivery, duties & taxes
We ship with DHL Express, fully insured and premium-wrapped. Delivery timescales, costs and how tracking works are set out on our Shipping & Delivery page. Orders shipped outside the UK may attract import duties or taxes on arrival, which are the recipient’s responsibility. Risk in the artwork passes to you on delivery.
7. Cancellation & returns
Your options in summary:
- You may amend or cancel your order within 48 hours of placing it.
- You may return an artwork within 14 days, provided it is in its original, resaleable condition; you cover the cost of return postage.
- If an item arrives damaged, please tell us within 30 days and we will cover return postage and arrange a repair or replacement.
Full details, and how to start a return, are on our Returns & Cancellations page. Nothing in these terms affects your statutory rights as a consumer.
8. Certificates of Authenticity
Original paintings and limited edition prints are supplied with a Certificate of Authenticity confirming the work and, for editions, its number within the edition. Please keep it safe, as it forms part of the artwork’s provenance.
9. Intellectual property
Buying an artwork gives you ownership of that physical piece. It does not transfer any copyright or other intellectual property rights, which remain with the artist. You may not reproduce, copy, or make commercial use of the artwork or its images without the artist’s written permission. All content on this website — including images, text and the site design — is likewise protected and may not be reused without our consent.
10. Our liability
We will carry out our obligations to you with reasonable care and skill. We are responsible for loss you suffer that is a foreseeable result of us breaking these terms, but we are not responsible for losses that are not foreseeable, or that arise from circumstances outside our reasonable control. Nothing in these terms limits our liability where the law does not allow it to be limited — including liability for death or personal injury caused by our negligence, or for fraud.
11. Governing law
These terms and any dispute arising from them are governed by the law of England & Wales, and are subject to the non-exclusive jurisdiction of the courts of England & Wales.
